Don’t let the hoops and loops of visa applications discourage you and your international love from being together. The K-1 Fiancé Visa is your ticket to bringing your foreign significant other to the United States, marrying and happily living together in the same place. Follow these tips on completing the fiancee visa application and take the first steps to making your life together possible.
The American first files a Petition for an Alien Fiancée. Send a completed Form I-129F to your local US Citizenship and Immigration Services office along with a filing fee. You must file this petition within US borders. The office will approve the petition and send it to the National Visa Center. Once processed and approved there your petition will be sent to the US embassy or consulate in your fiancée’s country. It is possible that the consulate or embassy revalidate the petition once it arrives if it has expired. The petition is valid for only 4 months.
The international fiancée must have a required medical examination. The examination often includes required vaccinations. The examination varies in cost, but it will be up to the couple to pay for the examination. The location the examination is performed differs between embassies and consulates. The medical examination form completed and signed by a doctor must accompany the visa application at the time of international fiancée’s interview.
The fiancée must gather required documentation to take to the immigration interview. The fiancée must also hold a valid passport in order to travel into the US along with a birth certificate. If she has been divorced or widowed in the past both death and divorce certificates must be included in the application package. She must also obtain police certificates from every place she has lived stating that she has not been involved in any crime or had any criminal convictions from age 16 on. The international applicant must also provide 2 nonimmigrant visa passport size photos.
Note that any foreign documents should be officially translated into the English language. Make sure your fiancée takes copies of her documents along with the originals to her interview so that the originals may be returned to her.
The foreign fiancée must complete the K-1 fiancee visa application forms. The international fiancee must also provide evidence of financial support with Form I-134. This guarantees that as an immigrant in the US she will not be allowed to apply for welfare, instead the person who financially supports her move to the US will be in charge of her wellbeing. Most often this is the American fiancé. This is to ensure that she does not become a liability to the state.
She must fill out 2 nonimmigrant visa applications (Form DS-156) along with 1 nonimmigrant fiancé(e) visa application (Form DS-156K). Make sure to use clear, legible handwriting and the English language and alphabet while filling out the application. Don't leave any spaces blank on the applications. If a section do not apply to your international fiancée she should write "N/A" indicating that she is not applicable.
The international fiancée must provide evidence of a romantic relationship. This could be phone records, plane ticket stubs from visiting one anther and photos. If the American citizen is present at the interview, which is highly recommended, you will both be asked questions about the other person to prove that you know one another and are not fabricating a relationship.
Once the international fiancée arrives in the United States on her temporary nonimmigrant fiancée visa you as a couple have 90 days to get married. If you do not get married within that time the fiancée will be deported back to her home country.
